In<\/span> March 2014<\/span> NCP Norway received <\/span> an anonymous<\/span> complaint<\/span> about conditions<\/span> at a<\/span> subsidiary of<\/span> a<\/span> Norwegian<\/span> company<\/span> in a non<\/span>–<\/span>OECD country.<\/span> The complainant<\/span> claimed that<\/span> the local management<\/span> has<\/span> been involved<\/span> in bribery and<\/span> that the parent company<\/span> has not responded<\/span> to a complaint<\/span> via<\/span> the company’s<\/span> own<\/span> whistleblower channel<\/span>. NCP Norway<\/span> was asked to<\/span> investigate the matter<\/span> with a view to<\/span> punish<\/span> the local management<\/span>.<\/span><\/p>\n

NCP<\/span> Norway has rejected<\/strong><\/span> the case<\/strong>,<\/span> partly because<\/span> of<\/span> the complainant’s<\/span> hidden<\/span> identity.<\/span> We recognize that<\/span> there may be legitimate<\/span> reasons to be<\/span> anonymous,<\/span> but<\/span> that makes it difficult for the NCP<\/span> to assess whether<\/span> the person has<\/span> a legitimate<\/span> interest in the matter<\/span>. That<\/span> is<\/span> one of the conditions<\/span> that must be met<\/span> in order for a<\/span> case to be considered.<\/span> Anonymity also makes it impossible to conduct <\/span>a meaningful<\/span> dialogue<\/span> between<\/span> the parties.<\/span> NCP<\/span> Norway suggested to the complainant that he\/<\/span>she could<\/span> be represented by<\/span> a third party,<\/span> but this<\/span> was not accepted.\u00a0<\/span> Another matter that the NCP is to take into account when considering if the issue merits further consideration is if <\/span>the <\/span>complaint is<\/span> substantiated.<\/span> In this<\/span> case<\/span>, the complainant put forward allegations but said that NCP Norway should investigate the matter for more information. W<\/span>e<\/span> explained that<\/span> we do not have<\/span> investigative<\/span> authority and that we are not a<\/span> judicial<\/span> body.<\/span> We<\/span> are a non<\/span>-judicial complaint<\/span> mechanism set up to<\/span> facilitate<\/span> dialogue<\/span> between<\/span> the parties.<\/span> The complainant<\/span> was not interested in such a dialogue<\/span>. The NCP<\/span> has<\/span> therefore<\/span> rejected the complaint.<\/span><\/p>\n

Even though, the <\/span>case<\/span> is rejected<\/span>, NCP Norway has in its Initial assessment given<\/span> some recommendations<\/span> and<\/span> observations to the company to<\/span> identify,<\/span> prevent,<\/span> mitigate and<\/span> manage risks<\/span> associated with<\/span> bribery<\/span>.\u00a0 We have among others, referred to guidance from the<\/span> OECD<\/a> and Transparency International.<\/a><\/p>\n
