{"id":1552,"date":"2014-06-18T10:15:14","date_gmt":"2014-06-18T08:15:14","guid":{"rendered":"https:\/\/nettsteder.regjeringen.no\/ansvarlignaringsliv\/?p=1552"},"modified":"2018-04-12T11:12:22","modified_gmt":"2018-04-12T09:12:22","slug":"ncp-norway-rejects-anonymous-complaint","status":"publish","type":"post","link":"https:\/\/nettsteder.regjeringen.no\/ansvarlignaringsliv2\/news\/ncp-norway-rejects-anonymous-complaint\/","title":{"rendered":"NCP Norway rejects anonymous complaint"},"content":{"rendered":"<div class=\"text-wrap post-content clearfix\"><p><span id=\"result_box\" lang=\"en\"><span class=\"hps\">In<\/span> <span class=\"hps\">March 2014<\/span> NCP Norway <span class=\"hps\">received <\/span> <span class=\"hps\">an anonymous<\/span> <span class=\"hps\">complaint<\/span> <span class=\"hps\">about conditions<\/span> <span class=\"hps\">at a<\/span> <span class=\"hps\">subsidiary of<\/span> <span class=\"hps\">a<\/span> <span class=\"hps\">Norwegian<\/span> <span class=\"hps\">company<\/span> <span class=\"hps\">in a non<\/span><span class=\"atn\">&#8211;<\/span>OECD <span class=\"hps\">country.<\/span> <span class=\"hps\">The complainant<\/span> <span class=\"hps\">claimed that<\/span> <span class=\"hps\">the local management<\/span> <span class=\"hps\">has<\/span> <span class=\"hps\">been involved<\/span> <span class=\"hps\">in bribery and<\/span> <span class=\"hps\">that the parent company<\/span> <span class=\"hps\">has not responded<\/span> <span class=\"hps\">to a complaint<\/span> <span class=\"hps\">via<\/span> <span class=\"hps\">the company&#8217;s<\/span> <span class=\"hps\">own<\/span> whistleblower<span class=\"hps\"> channel<\/span>. <span class=\"hps\">NCP Norway<\/span> <span class=\"hps\">was asked to<\/span> <span class=\"hps\">investigate the matter<\/span> <span class=\"hps\">with a view to<\/span> <span class=\"hps\">punish<\/span> <span class=\"hps\">the local management<\/span>.<\/span><\/p>\n<p><span class=\"hps\">NCP<\/span> Norway <span class=\"hps\">has <strong>rejected<\/strong><\/span> <span class=\"hps\"><strong>the case<\/strong>,<\/span> <span class=\"hps\">partly because<\/span> <span class=\"hps\">of<\/span> <span class=\"hps\">the complainant&#8217;s<\/span> <span class=\"hps\">hidden<\/span> <span class=\"hps\">identity.<\/span> <span class=\"hps\">We recognize that<\/span> <span class=\"hps\">there may be legitimate<\/span> <span class=\"hps\">reasons to be<\/span> <span class=\"hps\">anonymous,<\/span> <span class=\"hps\">but<\/span> that makes it difficult for the <span class=\"hps\">NCP<\/span> to assess <span class=\"hps\">whether<\/span> <span class=\"hps\">the person has<\/span> <span class=\"hps\">a legitimate<\/span> <span class=\"hps\">interest in the matter<\/span>. Tha<span class=\"hps\">t<\/span> <span class=\"hps\">is<\/span> <span class=\"hps\">one of the conditions<\/span> <span class=\"hps\">that must be met<\/span> <span class=\"hps\">in order for a<\/span> <span class=\"hps\">case to be considered.<\/span> Anonymity also makes it impossible <span class=\"hps\">to conduct <\/span><span class=\"hps\">a meaningful<\/span> <span class=\"hps\">dialogue<\/span> <span class=\"hps\">between<\/span> <span class=\"hps\">the parties.<\/span> <span class=\"hps\">NCP<\/span> Norway suggested to the complainant that <span class=\"hps\">he\/<\/span><span class=\"hps\">she could<\/span> <span class=\"hps\">be represented by<\/span> <span class=\"hps\">a third party,<\/span> <span class=\"hps\">but this<\/span> <span class=\"hps\">was not accepted.\u00a0<\/span> <span class=\"hps\">Another matter that the NCP is to take into account when considering if the issue merits further consideration is if <\/span><span class=\"hps\">the <\/span><span class=\"hps\">complaint is<\/span> substantiated<span class=\"hps\">.<\/span> <span class=\"hps\">In this<\/span> <span class=\"hps\">case<\/span>, the complainant put forward <span class=\"hps\">allegations but said that NCP Norway should investigate the matter for more information.
